GENERAL
PLEASE READ THIS AGREEMENT CAREFULLY. By submitting your application and by your use of the Service, you agree to comply with all of the terms and conditions set out in this Agreement. We may terminate your account at any time, with or without notice, for conduct that is in breach of this Agreement, for conduct that we believes is harmful to its business, or for conduct where the use of the Service is harmful to any other party. InOffice Soft Consulting may, in its sole discretion, change or modify this Agreement at any time, with or without notice. Such changes or modifications shall be made effective for all Subscribers upon posting of the modified Agreement to this web address (URL): http://www.webarrister.com/policies/ You are responsible to read this document from time to time to ensure that your use of the Service remains in compliance with this Agreement.

SERVICES
InOffice Soft Consulting offers Subscribers case management website, and library services for the duration of the service term purchased from www.webarrister.com. Services are provided on the basis of facility and equipment availability. InOffice Soft Consulting reserves the right not to provide one or more Services where necessary facilities or equipment are not available, or for any other reason. Access to the servers is terminated upon expiry of the Service. Details regarding your account can be found in your account control panel (www.webarrister.com/firm/)

CLOUD OFFICE
InOffice Soft Consulting provides Subscribers with a non-exclusive, non-transferable, limited license to use the WEBarrister. The WEBarrister is developed and owned by InOffice Soft Consulting, and any reproduction, modification, creation of derivative works from or redistribution of the WEBarrister is expressly prohibited. The WEBarrister, its structure, sequence, organization and source code are considered trade secrets of InOffice Soft Consulting. InOffice Soft Consulting does not claim ownership and is not responsible for any of the information, data, text, music, sounds, photographs, pictures, graphics, videos, messages, files or other materials ("User Content") submitted using the WEBarrister. Subscriber is entirely responsible for all User Content uploaded, posted, emailed or otherwise transmitted via the WEBarrister. You further acknowledge and agree that all User Content is non-transferable and non-transportable. We will not assist any Subscribers with any reproduction, recovery, or distribution of any User Content. Upon service cancellation or termination for any reason, access to the WEBarrister, including all User Content, third party content, and user information uploaded, posted, emailed, or otherwise transmitted via the WEBarrister, will be removed by www.webarrister.com. We makes no representations or warranties, either expressed or implied, with respect to the images offered through the WEBarrister (the "Images"). In the event of a dispute regarding any Image obtained via the WEBarrister, you hereby release www.webarrister.com, its officers, directors, owners, agents, and employees from claims, demands, and damages, actual and consequential, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any connection with such disputes. InOffice Soft Consulting is not a party to, and shall not be involved in or responsible for, transactions, agreements, and/or disputes between you and any third party.

DEFINITION USAGE
What "Limited" means: www.webarrister.com does not set an arbitrary limit on the amount of resources an account can use. What "Limited" DOES NOT mean: The accounts are not intended to support the greater data volume needs of large enterprise firm or to be used as an online storage warehouse to store backups, archiving of electronic files or emails, documents, log files, etc. or to be used as a media file streaming/sharing hub. Reselling any of the Service's resources is strictly prohibited. Any accounts found to be reselling resources will immediately be suspended, with or without notice. Reselling of account resources is only permitted if you have Partner login. InOffice Soft Consulting's "Limited" services are provisioned in a shared environment. Any account found to be adversely affecting the performance of other Subscriber accounts by excessively using network bandwidth, server storage, memory or CPU resources, will be flagged by www.webarrister.com administrators and anti-abuse controls. These Subscribers will then be asked to consider Dedicated Server services. Serious offenses will result in the account service suspension or termination, with or without notice.

SUBSCRIBER RESPONSIBILITY
When you apply to use www.webarrister.com services, you will be asked to select a Subscriber ID and Password. The Subscriber ID and Password are the means through which you access certain services. You acknowledge and agree that it is your responsibility to safeguard the Subscriber ID and Password you select from any unauthorized use. IN NO EVENT WILL INOFFICE SOFT CONSULTING BE LIABLE FOR THE UNAUTHORIZED USE OR MISUSE OF YOUR SUBSCRIBER ID OR PASSWORD. Subscribers are responsible for maintaining accurate account information at all times, including contact information. This information can be updated in your account settings firm page.

PROHIBITED CONDUCT
WEBarrister.com does not allow the use of unsolicited commercial marketing or promote your legal practice. Any Subscriber engaging in marketing or promoting through the www.webarrister.com network or promoting information on websites will be considered in breach of this Agreement and will be suspended from the Service immediately. Your use of the Service must be in compliance with Indian laws, and the laws of your country at all times. You are responsible for ensuring that your use of the Service does not consume excessive system or network resources that disrupts the normal use of the Service through, but not limited to, spawning multiple processes, or consuming excessive amounts of memory, CPU or bandwidth capacity. The following is a non-exclusive list of content, and behaviour prohibited by the Service:
  i. Content that contains or contains links to: nudity, pornography, adult content, materials with sex or foul language.
  ii. Content that condones, promotes, contains, or links to wares, cracks, hacks, their associated utilities, or other piracy related information, whether for educational purposes or not.
  iii. Content that has been promoted through the sending of Spam or mail fraud schemes, or pages that promote or condone the sending of Spam. The sending of bulk email originating from our servers mass distributed to unknown recipients soliciting products or services, or of bulk email NOT originating from our servers mass distributed to unknown recipients soliciting products or services relating to a www.webarrister.com account will result in immediate account suspension.
  iv. Content that is grossly offensive to the community, including blatant expressions for bigotry, prejudice, racism, hatred or excessive profanity, or to post any obscene, filthy, excessively violent, harassing, or otherwise objectionable material.
  v. Content or otherwise that exploits children under 18 years of age.
  vi. Content that sells or promotes any products or services that are unlawful in the location at which the content is posted or received.
  vii. Content that infringes or violates any copyright, patent, trademark, service mark, trade name, trade secret, or other intellectual property right of any third party.
  viii. Content that promotes mail fraud, multi-level marketing (pyramid) schemes or other illegal or fraudulent activities.
  ix. Content that posts or discloses any personally identifying information or private information about any third parties without their express consent.
  x. Reverse engineering, reverse compiling or otherwise deriving the underlying source code or structure or sequence of any www.webarrister.com service, solution or technology.
  xi. Reverse engineering, reverse compiling or otherwise deriving the underlying source code or structure or sequence of individual passwording of Subscriber Sites (or pages contained therein).

10. NOTICES
You agree that, unless other instructions are posted on www.webarrister.com's website, any notices required to be given under this Agreement will be deemed to have been given if delivered by email or fax, or sent by registered mail or by courier to each of the parties in accordance with the most current contact information you have provided to us, and the contact information for InOffice Soft Consulting is posted on the www.webarrister.com website. All notices shall be effective upon receipt, except that email and fax notices shall be effective upon transmission.

12. RESERVATION OF RIGHTS
www.webarrister.com reserves the right and sole discretion to:
  i. Censor any Library material on its servers that is deemed inappropriate.
  ii. Review any account for excessive space or bandwidth utilization and to suspend service to those accounts that have exceeded allowed levels.
  iii. Terminate any account for non-payment of fees, for providing fraudulent account information or fraudulent payment information.
  iv. Terminate any account if the contents of its cloud data results in, or are the subject of, legal action or threatened legal action against www.webarrister.com or any of its affiliates or partners, without consideration for whether such legal action or threatened legal action is eventually determined to be with or without merit.
  v. Terminate any account for unsolicited, unethical legal practice, illegal access to other computers or networks (i.e., hacking), distribution of Internet viruses or similar destructive activities, activities whether lawful or unlawful that we determines to be harmful to its other customers, operations or reputation, or for any breach of this agreement.
  vi. Suspend the Service at any time for any duration of time when necessary, without penalty or liability to ourselves.
You agree that it may be necessary for us to temporarily suspend the Service for technical reasons or to maintain network equipment or facilities.

17. GOVERNING LAW
The rights and obligations of the parties pursuant to this Agreement are governed by, and shall be construed in accordance with, the laws of the Rajasthan state and Indian laws. You may be subject to other local, state and national laws. You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the Rajasthan for any dispute arising under or relating to this Agreement and waive your right to institute legal proceedings in any other jurisdiction. We shall be entitled to institute legal proceedings in connection with any matter arising under this Agreement in any jurisdiction where you reside, do business or have assets.

18. WAIVER
No waiver of any of the provisions of this Agreement will be deemed to constitute a waiver of any other provision nor shall such a waiver constitute a continuing waiver unless otherwise expressly provided in writing duly executed by the party to be bound thereby.

19. ENTIRE AGREEMENT
This Agreement, as may be updated from time to time and posted at http://www.webarrister.com/terms-and-conditions/, represents the complete agreement and understanding between us with respect to the Service and supersedes any other written or oral agreement.

LIMITATION OF LIABILITY
The Service is provided on an "as is" and "as available" basis and the use of the Service is at your own risk. InOffice Soft Consulting makes no representations or warranties, either expressed or implied, with respect to the Service, or any service or information provided through the Service. www.webarrister.com is not responsible for any damages, injury or economic loss arising from the use of the content or Service provided by www.webarrister.com. In no event will InOffice Soft Consulting be liable to you for any direct, indirect, incidental or consequential damages or economic loss arising out of the Service or in connection with your website or any other services or products provided to you. InOffice Soft Consulting, its officers, directors, owners, agents and employees shall in no way be liable to you or anyone else for any loss or injury resulting from the use of the Service or of your website. In no event shall InOffice Soft Consulting be held liable for any damages or economic loss, whatsoever, as a result of notifying any official of potentially illegal content on our website posted by user, or for providing copies of your data files to the appropriate authorities or cooperating with law enforcement efforts to locate persons who have posted content that is illegal or promotes illegal conduct.

INDEMNIFICATION
You agree to indemnify and hold InOffice Soft Consulting harmless from and against, and to reimburse www.webarrister.com with respect to, any and all losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) of every nature whatsoever incurred by InOffice Soft Consulting by reason of or arising out of or in connection with:
  • Any breach of this Agreement by you.
  • Any infringement of any copyright, trademark, patent, trade secret or any other intellectual propriety right of any party by content on our website posted by you.
  • Illegal, pornographic, or discriminatory content on your website.

FORCE MAJEURE
InOffice Soft Consulting will not be liable for any delay, interruption or failure in the provisioning of services if caused by acts of God, declared or undeclared war, fire, flood, storm, slide, earthquake, power failure, the inability to obtain equipment, supplies or other facilities that are not caused by a failure to pay, labour disputes, or other similar events beyond our control that may prevent or delay service provisioning.

UNENFORCEABLE PROVISIONS
If any part of this Agreement is found to be invalid or unenforceable under applicable law, such part will be ineffective to the extent of such invalid or unenforceable part only, without affecting the remaining parts of this Agreement in any way.

COLLECTED INFORMATION
Personal information is requested when you register to become a member. During your firm registration, you are asked to provide your name, email address, postal code, etc. The more information you submit and the more accurate it is, the better we are able to tailor our services to your needs. Additional information, such as your IP address, operating system, or browser information, may be collected whenever you interact with us or our website. We collect this information in order to compile usage statistics.

COOKIES
Whenever you interact with us or our website, www.webarrister.com may place a "cookie" in the browser files of your computer. Cookies are data files that help your browser communicate with www.webarrister.com. Most browsers are set to accept cookies by default. You can reject or block cookies by changing your browser settings. However, if your browser rejects or blocks a cookie, it may impact your ability to use some of our website and our service.

USE OF INFORMATION
www.webarrister.com's purpose in collecting personal information is to identify the member as well as to send recent updates and important announcements via post and/or email. In order to serve our members better, we do research on our members' demographics and interests based on the information you submitted to us upon registration. We will not disclose or transfer your personal information to any third parties. We reserve the right to disclose or transfer your personal information under the following conditions:
i) We have your consent to do so.
ii) We believe that it is necessary to do so in order to respond to any claims.
iii) We believe that it is necessary to do so in order to comply with the law, legal processes, or authorities.
iv) We believe that it is necessary to do so in order to protect the rights, property, interests, or safety of www.webarrister.com, our employees, our users, or the public.
v) We are required to do so in connection with an acquisition, merger, or sale of all or a portion of our business.

ONLINE SECURITY
The online transaction processing is provided by Citrus Payment Solutions PTE using the highest commercially available encryption technology - Extended Validation (EV) SSL Certificate encryption. All confidential information is automatically encrypted before it is transmitted, to protect the data from being read and interpreted.

SERVICE FEES / PAYMENTS / INVOICES
All www.webarrister.com fees and charges are quoted and billed in Indian Rupee unless otherwise noted. www.webarrister.com uses an automated payment processing system and only accepts credit card or debit card at this time. All Subscribers are required to provide www.webarrister.com with valid payment information for the processing of any applicable service fees. www.webarrister.com may take any reasonable action to validate your payment and registration information, and collect all payments due. You agree to pay all attorney and collection fees arising from any efforts to collect any past due amounts from you, to the extent allowed by law. Service fees are due at the time of order or on the day of renewal. All fees must be paid in full. Billing inquiries and disputes should be brought to InOffice Soft Consulting's attention within 30 days of the invoice date. Failure to do so will be deemed to be an admission that the invoice and charges are accurate. If any chargeback or charge dispute notices are received for your account, services provided to you may be immediately suspended pending investigation, and you will be subject to chargeback service charges. Where applicable, www.webarrister.com reserves the right to put your subscription into "Hold" status until the chargeback or dispute issue has been resolved. Accounts will be suspended if its service renewal fees are not paid within 10 days of the due date. Accounts suspended in this manner can be re-activated upon payment. Any applications or requests for services will be declined if payment cannot be successfully processed within 72 hours of the order. InOffice Soft Consulting reserves the right to modify service fees and rates, effective upon posting on the www.webarrister.com website or on this Agreement. Current service charges include the following (non-exclusive list):

TERMINATION / PLAN CHANGE / REFUND POLICY
InOffice Soft Consulting may terminate your Service under the following circumstances (non-exclusive list):
  i. Non-payment of fees
  ii. You are in breach of any term or condition of this Agreement
  iii. Your use of the Service disrupts www.webarrister.com business operations or affects any other party

All Subscriber data is removed from www.webarrister.com servers for such terminations. You may request account termination or subscription plan changes at any time by contacting our Customer Service team either through phone or email. Our contact information can be found on the Feedback page of our website: http://www.webarrister.com When submitting your cancellation request, you must provide the correct username and password for your account for verification. Incomplete cancellation requests will be deemed invalid and will not be processed. You will be responsible for any service fees that arise from your failure to cancel your account. You are eligible for a refund under the following circumstances only:

  i. If you cancel your account within 30 days of sign-up, you will, upon request, receive a refund of the subscription fees paid, less any setup fees.
  ii. If you cancel your account within 45 days of a service renewal, you will, upon request, receive a full refund of all subscription fees paid on your most recent renewal.
  iii. If you cancel your account within 14 days of a subscription plan change, you will, upon request, receive a full refund of all subscription fees paid on your most recent subscription plan change, less any setup fees.

Only one refund may be issued for each invoice. www.webarrister.com reserves the right to grant or deny any refund requests.

DIGITAL
www.webarrister.com provide all its product and services in digital format over internet. All products are subscription to the shared servers. We provide support services for our products over phone, email or support system. We maintain these as per our archival policies and does not deliver any such content to our subscribers. Therefore all products and services are delivered to you virtually over internet.

GENERAL
EMAIL Server, often referred to as simply "mail server", an e-mail server is a virtual post office. A mail server usually provide sender facility to chose the recipient, subject and message of the e-mail. Communications modules which are the components that actually handle the transfer of messages to and from other mail servers and email clients. Most mail servers are designed to operate without any manual intervention during normal operation. Similarly, WEBarrister holds no manual intervention and storage of the messages on our servers.

SENDER is a registered user on WEBarrister (www.webarrister.com). S/He/They manages and maintain their cases and relevant information like contact information related to the case. WEBarrister provide email composer which aid communication with related stake holders informative and quick.

RECIPIENT receive communication in plain text from WEBarrister on behalf of sender and the communication is only between sender and recipient(s). WEBarrister hold no information about the communication. Reply from recipient(s) will go directly to the sender's registered email address at WEBarrister.

EMAILS are plain text communication with no attachment therefore no risk of virus. May you feel you are not authorised recipient of communication, please bring that in notice to member@webarrister.com. We will track the sender through registred email and inform accordingly.
